Arson attempt: exclusion of penalty-exempting withdrawal where offender departed while fire risk persisted despite lack of culpability
Legislator-Zusammenfassung
KI-generiertThe BGH 4th Criminal Senate rejected the defendant's revision, upholding the Landgericht Dortmund's judgment of February 18, 2025, and ordered the defendant to bear the costs of the appeal. The case involved a challenge to a judgment concerning attempted arson, where the defendant was acquitted of the intent-based crime due to a lack of culpability but was otherwise subject to security measures. The court held that the absence of explicit findings regarding the temporal aspect of withdrawal from the crime under § 24 Abs. 1 Satz 1 StGB did not jeopardize the verdict, as the record sufficiently established that the defendant did not effectively withdraw. The decisive legal basis rests on the doctrine that a "penalty-exempting" withdrawal is only valid if the offender voluntarily prevents the occurrence of the result; here, the defendant left the scene while the fire was actively developing and aware of the imminent danger to an adjacent house, thereby failing to meet the requirements for withdrawal, a prerequisite that must be examined even when the offender is not punished due to lack of criminal responsibility.

Rspr.; BGH, Beschluss vom 7. Mai 2024 – 4 StR 82/24, StV 2025, 386; Beschluss vom 10. August 2022 – 1 StR 234/22 Rn. 6 mwN; Urteil vom 28. Oktober 1982 – 4 StR 472/82, BGHSt 31, 132, 135).
