Admission of revision for damages from defective thermal window installation and insufficient insulation disclosure.
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the appellate court's judgment which rejected the plaintiff's claims; the court ordered the plaintiff to bear the costs of the complaint proceedings and set the matter in dispute at up to €25,000. The dispute concerned a civil claim where the plaintiff challenged the lower court's refusal to admit revision, arguing the case had fundamental legal significance or required legal development. The BGH ruled that the complaint failed because the plaintiff did not sufficiently demonstrate the decision-relevance of the legal questions raised under §§ 543(2) No. 1 and 2(1) ZPO; the appellate court had validly based its decision on the plaintiff's failure to prove damage resulting from the installation of a thermal window and a lack of sufficient factual submissions regarding other insulating measures, constituting an independent and sufficient legal basis that precluded admission of revision under § 544 ZPO.
