Admissibility of ECJ reference on good faith in insurance policy guideline conformity; denial of revision for lack of prospects of success
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby leaving the appellate court's judgment in force and awarding the respondent the costs of the proceedings. The dispute concerned the guideline conformity of an insurance policy model and the defense of *treu und glauben* (good faith), where the plaintiff had attempted to trigger a reference to the European Court of Justice. The BGH held that neither the guideline conformity nor the good faith defense required a preliminary reference, citing established precedent that such issues do not necessitate EU Court intervention in this context. The court further determined that the revision lacked prospects of success, reaffirming that the lower court's decision stood without the need for a higher court review under § 543(2) ZPO.
