Defense counsel's right of access to the internal senate notebook as excluded from the scope of judicial case records
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the motion by a defense counsel for access to the senate notebook in a criminal revision proceeding. The dispute centered on whether the defense attorney was entitled to inspect the internal working papers and notes of the judicial panel. The court held that such documents constitute internal administrative materials and do not form part of the official court record subject to the statutory right of inspection under § 475 and § 478(2) of the Code of Criminal Procedure (StPO), as all substantive materials contained within the notebook are already accessible in the main case files, thereby negating any specific need for separate access.

Akteneinsichtsrecht: Anspruch eines Verteidigers auf Einsicht in das Senatsheft
[TENOR]
