The Federal Court of Justice (IVth Civil Senate) dismissed the plaintiff's complaint against the non-admission of leave to appeal, leaving the lower court judgment of July 29, 2021, in force, and ordered the plaintiff to bear the costs of the proceedings. The dispute concerned insurance law, specifically the plaintiff's challenge regarding the directive-compliance of a policy model and an argument based on the prohibition of abuse of rights (venire contra factum proprium). The court determined that these issues were not decisive for the outcome and that a preliminary reference to the Court of Justice of the European Union was not required, citing relevant precedent; furthermore, the court explicitly assessed and denied the prospects of success for a full revision based on the lack of fundamental legal significance, the need for legal development, or the requirement for uniform jurisprudence under Section 543(2) Sentence 1 of the Code of Civil Procedure.
