Insurance policy model and good faith defense: no preliminary reference to CJEU required for non-admission of revision
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (4th Civil Senate) dismissed the plaintiff's complaint against the non-admission of revision, thereby leaving the Munich Higher Regional Court's judgment of July 5, 2021, in force. The dispute concerned insurance law, specifically challenging the admissibility of a policy model and raising a *venire contra factum proprium* (estoppel) defense based on principles of good faith. The court determined that neither the compatibility of the policy model with EU directives nor the specific estoppel argument required a reference to the Court of Justice of the European Union, relying on recent Senate precedents to conclude that the case lacked fundamental legal significance for revision purposes. The dismissal was grounded in §§ 543, 544 ZPO (Code of Civil Procedure) and Art. 103 GG (German Basic Law), with the plaintiff ordered to bear the costs of the complaint proceedings.
