Explosive explosion liability: limiting proceedings to exclude concurrent bodily injury charge and amending conviction under § 154a StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (6th Criminal Senate) partially granted the defendants' appeals, limiting the proceedings under § 154a(2) StPO to exclude the charge of dangerous bodily injury for one count and amending the Landgericht Stendal’s judgment to convict one defendant of unauthorized handling of explosive-substance-hazardous materials and causing an explosive explosion, and the other defendant solely of causing an explosive explosion, while rejecting the remainder of the appeals and ordering the defendants to bear the costs. The case involved two defendants convicted by the lower court for causing an explosive explosion in concurrence with dangerous bodily injury in two cases, with one additionally facing unauthorized handling charges; the appeal challenged the factual and legal aspects of these convictions. The decisive legal basis was § 349(4) StPO, which allowed the court to modify the judgment based on the valid factual arguments without a full retrial, while the exclusion of the concurrent bodily injury charge did not affect the sentencing because the original court had not cited the multiple concurrent offenses as an aggravating factor, relying instead on legitimate evaluation of health consequences.

schuldig ist.

[GRUENDE]
BGH, Beschluss vom 29. November 2017 – 5 StR 335/17, NStZ-RR 2018, 41).
