Admission of revision in insurance dispute: EU directive conformity and good faith preclusion requiring preliminary CJEU reference
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby leaving the Munich Higher Regional Court's judgment of 28 April 2022 in force, and ordered the plaintiff to bear the costs of the proceedings. The dispute concerned a civil litigation matter where the plaintiff challenged the lower court's decision, arguing a violation of equality under Article 3(1) of the Basic Law combined with the rule-of-law principle, as well as asserting that the case required a reference to the European Court of Justice regarding the consistency of the insurance policy model with EU directives and issues of good faith. The BGH ruled that the case lacked fundamental legal significance and did not require the development of law or the securing of uniform jurisprudence under Section 543(2) Sentence 1 ZPO, finding that a preliminary reference to the CJEU was not necessary and that the revision would have no prospect of success.
