Non-admission of revision in insurance law: EU directive conformity and preliminary reference on good faith not decisive
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's decision and denying the plaintiff relief. The dispute concerned an insurance contract, specifically addressing the compatibility of a policy model with EU directives and the applicability of the principle of good faith (Treu und Glauben). The court held that these issues were not decisive for the outcome and that no preliminary reference to the European Court of Justice was required, relying on recent precedent to find that the plaintiff had no reasonable prospects of success on revision.
