Insurance policy EU guideline conformity and estoppel: No preliminary CJEU ruling required for non-admission of revision
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of an appeal to the Revisionsgericht, leaving the lower court’s decision in force and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned an insurance contract, where the plaintiff argued that the policy model lacked conformity with EU guidelines and that the insurer’s reliance on estoppel violated principles of good faith, necessitating a preliminary ruling from the Court of Justice of the European Union. The court held that EU guideline conformity was not decisive for the outcome and that no referral to the CJEU was required regarding the good faith argument, citing prior case law; it further determined that the appeal lacked prospects of success and did not present a fundamental question of law or a need for uniform jurisprudence under § 543 Abs. 2 ZPO, while also rejecting the plaintiff's hearing claim under Art. 103 Abs. 1 GG.
