Consumer loan: validity of withdrawal notice to co-borrowers via co-possession of text-form document under pre-2010 § 355 BGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiffs' complaint against non-admission of appeal, rejecting their application for leave to appeal and leaving the appellate court's decision in force. The dispute concerned a consumer loan with multiple borrowers, specifically challenging whether the requirement for written form in the withdrawal information was satisfied when co-borrowers only obtained co-possession of the document. The court held that there is no fundamental legal significance to the case and that a revision is not required for the development of law or to ensure uniform jurisprudence, noting that the appellate court correctly applied § 355 para. 2 sentence 1 of the German Civil Code in its pre-June 10, 2010 version, which is fulfilled if co-borrowers gain co-possession of the withdrawal notice in text form.

[TENOR]
Januar 2016 - 23 U 42/15, juris Rn. 25 ff.; OLG Hamm, WM 2016, 116, 122 f.; Bülow, WuB 2016, 207, 210; Martis/Meinhof, MDR 2004, 4, 6; MünchKommBGB/Fritsche, 7. Aufl., § 355 Rn. 30 Fn. 48; Staudinger/Kaiser, BGB, Neubearb. 2012, § 355 Rn. 55; aA Knops/Martens, WM 2015, 2025, 2027 f.).
