Dinglicher Arrest: Permissibility of court determination under § 111i Abs. 2 StPO despite opening of insolvency proceedings against auxiliary party
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the appeal filed by the auxiliary party as unfounded, thereby upholding the judgment of the Stuttgart Regional Court of 30 May 2016 and ordering the appellant to bear the costs of the legal remedy. The dispute concerned the maintenance of an in rem attachment (dinglicher Arrest) in criminal proceedings after the insolvency proceedings had been opened over the assets of the auxiliary party. Ruling on the decisive legal basis, the Court clarified that the opening of insolvency proceedings does not preclude the court from making a determination under § 111i Abs. 2 of the Code of Criminal Procedure (StPO) regarding the attachment, thereby confirming that the attachment remains valid despite the insolvency status.
