Attribution of co-defendant's refusal to answer confrontation questions to judicial authorities under Art. 6(3)(d) ECHR
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Justice (5th Criminal Senate) rejected the defendant's appeal, upholding the lower court's conviction and ordering the appellant to bear the costs of the proceedings. The case involved a challenge to the fairness of a criminal trial, specifically alleging a violation of the right to confront a co-defendant who refused to answer questions posed by the defendant or their counsel during the main hearing. The court held that no violation of the right to a fair trial or the right of confrontation under Article 6(3)(d) of the European Convention on Human Rights occurred, as the co-defendant's refusal to answer was not attributable to the judicial authorities.
Legislator-Regeste
BGH, Beschluss vom 9. Juni 2009 - 4 StR 461/08, NStZ 2009, 581; LR-StPO/Sander, 26. Aufl., § 261 Rn. 83e mwN).
