The Federal Court of Justice (1st Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the conviction and ordering the defendant to bear the costs. The case involved a criminal appeal challenging a conviction for sexual abuse of a defenseless person under § 179 of the former German Criminal Code (StGB), with the dispute centering on the legal effect of the repeal of § 179 StGB by the 2016 Act on the Improvement of Protection of Sexual Self-Determination, which entered into force after the lower court's verdict. The court held that the conviction remained valid because § 179 StGB aF was effectively incorporated into the newly amended § 177 StGB nF, constituting a successor regulation that maintained the same protected legal interests and prohibited conduct; consequently, since the current law was not more lenient, the principle of necessary continuity of illegality allowed the court to apply the former provision under § 2 Abs. 3 StGB.

Sexualdelikt: Schuldspruch wegen sexuellen Missbrauchs widerstandsunfähiger Personen nach erfolgter Neuregelung

[TENOR]
