Reinstatement in criminal proceedings after missed appeal deadline due to violation of right to a fair trial following European Court of Human Rights judgment
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice granted the accused reinstatement in the previous position, rendering the prior decision denying such relief void, and mandated the lower court to immediately review the provisional detention order. The dispute concerned the accused's failure to file an appeal within the statutory deadline, which the court attributed to a violation of the right to a fair trial under the European Convention on Human Rights, specifically referencing a prior judgment by the European Court of Human Rights. The decisive legal basis for granting reinstatement on the accused's own costs was the violation of the right to a fair procedure, leading to the restart of the appeal reasoning period upon service of the new decision or any supplementary judgment reasons under § 267 Abs. 4 Satz 4 StPO, and triggering an immediate review of the interim commitment under § 47 Abs. 3, § 126 Abs. 2 Satz 2 StPO.
