The German Federal Court of Criminal Justice (BGH) rejected the defendant's revision as unfounded, affirming the conviction rendered by the Landgericht Bochum and ordering the defendant to bear the costs of the appeal. The dispute centered on an "Inbegriffsrüge" (comprehensive objection), where the defendant alleged that the trial court violated Section 261 StPO by failing to mention specific evidence—a passage from a police interrogation record read into the proceedings—in the judgment's reasoning. The court determined that the lack of mention in the written reasons could only prove a failure to consider the evidence if it was essential to the conviction based on the factual situation at the time of judgment; however, because the content of the trial witness testimony regarding the police officer was unknown to the appellate court due to the prohibition against reconstructing the trial court's evidentiary findings, the alleged legal error could not be substantiated. Consequently, the revision was dismissed as the procedural requirement for demonstrating a constitutional error in the assessment of evidence under Section 337 StPO was not met.

Inbegriffsrüge im Strafverfahren: Fehlende Erwähnung eines Beweisergebnisses in den Urteilsgründen; unterbliebene Erörterung eines Beweisergebnisses im Rahmen der Beweiswürdigung

[TENOR]

BGH, Urteil vom 4. August 2011 - 3 StR 120/11, NStZ 2012, 49; Beschlüsse vom 27. Juli 2005 - 2 StR 203/05, NStZ 2006, 55 f.; vom 7. August 2007 - 4 StR 142/07; Frisch in SK-StPO, 4. Aufl., § 337 Rn. 77 f., 84 f. mwN; Franke in Löwe/Rosenberg, StPO, 26. Aufl., § 337 Rn. 58 mwN).
