CS tear gas as a dangerous instrument for aggravated robbery and grievous bodily harm
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (1st Criminal Senate) dismissed the defendant's appeal as unfounded, upholding the Landgericht Heidelberg's conviction and ordering the defendant to bear the costs of the legal remedy. The dispute centered on whether the use of a CS tear gas spray during a robbery constituted the use of a "dangerous instrument" to establish aggravated robbery and grievous bodily harm. The court confirmed that the defendant’s actions—knocking the victim's glasses off and spraying CS gas directly into her eyes, causing immediate severe pain, temporary blindness, and nausea to seize her handbag and smartphone—met the statutory threshold for employing a dangerous weapon. The decisive legal basis is § 250 Abs. 2 Nr. 1 Alt. 2 StGB (aggravated robbery) and § 224 Abs. 1 Nr. 2 Alt. 2 StGB (grievous bodily harm), where the court ruled that CS tear gas spray, as classified under the Weapons Act, is legally defined as an "other dangerous instrument" due to its capacity to cause significant injury when used in this manner.

Schwerer Raub: Reizgas als "anderes gefährliches Werkzeug"
[TENOR]
