Threshold for loss of visual capacity constituting grievous bodily harm under § 226(1)(1) StGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the defendants' appeals as unfounded, leaving the conviction by the Regional Court of Mosbach in force and ordering each defendant to bear the costs of their own legal proceedings and the necessary expenses incurred by the civil parties. The dispute concerned the qualification of the injury as grievous bodily harm under German criminal law, specifically challenging whether the damage inflicted met the statutory threshold for severe consequences. In a binding clarifying remark, the Senate established that the loss of visual capacity under § 226(1)(1) StGB is fulfilled if there is a permanent reduction of visual acuity to 2% in one eye.
