Legislator-Zusammenfassung

The Federal Court of Civil Procedure rejected the plaintiff’s representative’s objection to the prior dispute value determination, thereby upholding the initial ruling. The dispute concerned whether statutory interest claims totaling approximately €69,964.90, which were subject to a plaintiff's unilateral declaration that part of the main claim was settled (erledigt), should be counted as additional dispute value for court fee purposes. The court held that such interest functions as an accessory claim and does not increase the dispute value under § 43(1) GKG because the primary underlying claim remained in litigation; a lack of dependency between the accessory and main claims, which would trigger inclusion under § 43(2) GKG, did not exist as the settlement declaration had not been accepted by the opposing party, leaving the main claim active.

BGH, Beschluss vom 4. April 2012 - IV ZB 19/11, MDR 2012, 738).
