Compensation payment for exclusive usage right over area not provided in partition declaration following structural renovation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendants' complaint against the non-admission of revision, thereby leaving the lower court's judgment in force and ordering the defendants to bear the costs of the appellate proceedings. The dispute concerned whether a compensation payment is required under § 10 Abs. 2 Satz 3 WEG to grant exclusive usage rights over an area not originally provided for in the partition declaration following renovation measures. The court held that while it had not previously ruled on this specific issue, compensation was not decisive in this case because the defendants were not surprised by the deviation from the partition declaration and had explicitly consented to the renovations without conditioning their approval on a compensation payment.

Wohnungseigentum: Ausgleichszahlung bei Sondernutzungsrecht eines Eigentümers nach Umbaumaßnahme
[TENOR]
