Legislator-Zusammenfassung

KI-generiert

The defendant's appeal was rejected as inadmissible, resulting in the upholding of the lower court's judgment. The dispute centered on the procedural validity of the appellate brief filed in a criminal case, specifically concerning the form of the lawyer's signature. The court held that a handwritten signature on a digitally transmitted document, lacking the full civil name and accompanied only by the title "Attorney," did not satisfy the statutory requirements for a "simple" signature under § 32a Abs. 3 StPO, even when the lawyer was identified in the letterhead. Consequently, the appeal was dismissed as admissibility failed, and the defendant was ordered to bear the costs of the appeal; the court further noted that the substantive grounds for the appeal would have been meritless regardless of the procedural defect.

BGH, Beschluss vom 9. April 2025 - XII ZB 599/23 Rn. 9 mwN).

Die Revision wäre im Übrigen auch unbegründet.
