Litigation value of declaratory claim for conversion of loan contract into restitutionary obligation following consumer rescission
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) declared the appellants' appeal for revision (Rechtsbeschwerde) lost following their withdrawal of the appeal against the Oberlandesgericht Koblenz's decision, imposing the appellate costs on them and fixing the matter's value at up to €45,000. The dispute concerned the assessment of litigation value for a declaratory action seeking to establish that a loan contract had been converted into a restitutionary obligation (Rückgewährschuldverhältnis) following the rescission of a consumer loan. Relying on §§ 357, 346 ff. BGB (in the version valid until June 12, 2014), the court ruled that the relevant litigation value is determined by the interest and principal payments made by the borrower up to the point of rescission, excluding subsequent payments or potential unjust enrichment claims under § 814 BGB which were not covered by the specific declaratory claim.
