Consumer credit: Exclusion of statutory withdrawal right after full loan discharge
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the borrower’s non-appeal complaint, thereby upholding the lower court’s decision and leaving the borrower to bear the costs of the appellate proceedings. The dispute concerned the validity of a withdrawal declaration under consumer credit law, specifically whether a borrower could retract a loan agreement after it had been fully performed. The court held that the case lacked fundamental legal significance because existing jurisprudence already established that the right to withdraw under Article 14(1) of Directive 2008/48/EC (Consumer Credit Directive) does not survive the full discharge of the loan contract, a principle confirmed by the Court of Justice of the European Union and prior BGH decisions. Consequently, no further revision was required to ensure uniform legal application.
