Hearing objection against denial of legal aid for lack of merit under § 114 ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 9th Civil Senate dismissed the plaintiff's hearing objection (Anhörungsrüge) against a prior Senate order, leaving the underlying denial of legal aid in force. The dispute concerned a request for procedural legal aid (Prozesskostenhilfe), where the plaintiff argued that the court had overlooked specific arguments in its initial decision to reject the application. The court found the objection unfounded, confirming that the arguments had been examined but deemed insufficient to demonstrate a reasonable prospect of success, and refused to provide further detailed reasoning. The decision relied on § 114 (1) sentence 1 ZPO for the initial denial due to lack of merit and § 544 (6) sentence 2 ZPO, which permits abbreviated justifications in legal aid proceedings, citing established jurisprudence that such cases do not impose greater explanatory duties than non-admission complaints.

BGH, Beschluss vom 25. April 2006 - IV ZA 22/05, FamRZ 2006, 1029; vom 30. September 2025 - II ZA 1/24, juris Rn. 2).
