Correction of appellate judgment tenor for omitted out-of-court legal fees and interest
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, upholding the lower court's judgment, while ordering a correction to the operative part of the judgment to explicitly include the defendant's liability for unpaid out-of-court legal fees and associated interest. The dispute arose from a civil litigation where the appellate court had recognized the plaintiff's claim for specific legal costs and interest in its reasoning but failed to implement this finding in the final dispositive order (Tenor). The BGH applied § 319 Abs. 1 ZPO to remedy this evident error in the judgment's tenor, thereby clarifying that the defendant must pay the plaintiff €2,085.95 plus interest at a rate of 5 percentage points above the base rate since March 15, 2016, while the substantive dismissal of the revision appeal remained in force under § 544 Abs. 6 ZPO.
