Criminal sentencing: sufficiency of legal prognosis to deny probation for short-term imprisonment
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 4th Criminal Senate dismissed the appeals of two defendants as unfounded, upholding the convictions and sentences imposed by the Essen District Court; the defendants bear the costs of the appeal, with one additionally liable for the victim's litigation expenses. The dispute concerned criminal appeals against a lower court judgment, where the defendants challenged the sentencing, specifically alleging an error in the sentencing court's failure to consider probation for one defendant's nine-month imprisonment. The court held that no prejudicial legal error occurred, affirming the lower court's finding that a favorable legal prognosis for granting probation was absent given the defendant's personal circumstances, pursuant to § 56 StGB and § 337 StPO.
