Insurance policy model directive conformity and good faith defense; non-admission of revision
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (IV Civil Senate) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the Munich Court of Appeal's earlier decision and leaving the lower court's judgment in force. The dispute involved a civil insurance matter where the plaintiff challenged the directive conformity of an insurance policy model and invoked good faith (Treu und Glauben), but the court held these issues were not dispositive for the outcome. Relying on § 543 Abs. 2 Satz 1 ZPO, the court determined that the case lacked fundamental legal significance and did not require further development of the law or uniform application of legal principles, thus denying the referral to the Court of Justice of the European Union as unnecessary; the plaintiff was ordered to bear the costs of the complaint proceedings, and the amount in dispute was set at €20,739.37.
