Termination of criminal appeal for child sexual abuse due to death of the accused and waiver of defendant's costs under § 206a StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 2nd Criminal Senate ordered the termination of the proceedings and waived the imposition of the defendant's necessary legal expenses on the public prosecutor, leaving the lower court's conviction without legal effect. The dispute arose from a trial where the Regional Court had convicted the defendant of child sexual abuse in six counts, resulting in a total prison sentence of two years and nine months, while dismissing three other counts and acquitting in the remainder; the case reached the BGH on appeal, but the defendant passed away during the review process. The decisive legal basis was § 206a StPO, which mandates the termination of criminal proceedings upon the death of the accused, rendering the appeal moot and the prior judgment obsolete without the need for a formal reversal. Consequently, under § 467 StPO, the public prosecutor bore its own costs, and the court exercised its discretion under § 467 Abs. 3 Satz 2 Nr. 2 StPO to forgo charging the defendant's necessary expenses to the state because the conviction would have stood on its merits, as no procedural errors detrimental to the defendant were found in the substantive review.

1. Das Verfahren wird eingestellt.
Januar 2025 - 2 StR 253/24, Rn. 4).
