Inadmissibility of extraordinary appeal against insolvency court decision refusing leave to appeal
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the debtor's filing, characterized as an appeal on points of law, as inadmissible at her expense, leaving the lower court's judgment in force. The dispute arose in insolvency proceedings where the debtor attempted to challenge a decision by the Regional Court of Weiden that did not grant leave to appeal. The decisive legal basis was Section 574(1) sentence 1 number 2 and Section 577(1) sentence 2 of the Code of Civil Procedure, which render such decisions unchallengeable via extraordinary appeal where leave to appeal is denied, and the court found no constitutional necessity to open a different legal path.
