Tax fencing of untaxed tobacco: acquisition via interim storage constitutes completed offense despite seizure by customs
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's revision as unfounded, upholding the conviction from the Landgericht Duisburg and ordering the defendant to bear the costs of the appellate proceedings. The dispute concerned the legal classification of the defendant's role in a scheme involving the cross-border trafficking of fine-cut tobacco introduced into Germany without paying taxes or duties, which she had received from a principal, stored, and handed over for transport back to the United Kingdom. The court held that the defendant committed habitual tax fencing (§ 374 para. 1 and 2 AO) by "acquiring" the contraband, a classification that applied regardless of whether the tobacco was seized by British or German customs authorities after she had taken possession of it. The Court confirmed that this shift in legal assessment did not violate the principle of legality under § 265 StPO, as the defendant, who had pleaded guilty, could not have defended herself more effectively against the modified charge than she did.
