Admissibility of revision appeal concerning EU directive conformity of insurance model and estoppel without prior ECJ reference
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (IV Zivilsenat) dismissed the plaintiff's non-acceptance complaint, leaving the appellate court's decision refusing to permit the appeal in revision intact. The dispute concerned a liability matter where the plaintiff, who argued that the court violated its duty to clarify the facts (Art. 103(1) GG) and failed to address the EU directive conformity of the insurance policy model or the defense of estoppel (Treu und Glauben), sought to escalate the case. The court found no fundamental significance, need for legal development, or requirement for uniform jurisprudence to justify an appeal in revision under § 543(2)(1) ZPO, noting that the directive conformity issue was not dispositive and that a preliminary reference to the European Court of Justice regarding estoppel was unnecessary based on established precedent. The plaintiff is ordered to bear the costs of the complaint proceedings, with the amount in dispute capped at €450,000.
