Adhesion proceeding: Abandonment of remaining damages and tortious conduct claims without full determination under § 406(1) StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the defendant's appeal, with the specific modification that the appellate court abstained from deciding on remaining adhesion claims under § 406(1) Code of Criminal Procedure (StPO), thereby upholding the lower court’s judgment while correcting its failure to fully dispose of the adhesion procedure. The dispute concerned a criminal trial where the Landgericht Siegen had previously issued a foundational judgment on a pain and suffering claim and completely failed to decide on the defendant's intent in tortious conduct, constituting a procedural omission in the adhesion proceedings. The decisive legal basis was the application of § 406(1) StPO, which permits the court to refrain from deciding on further adhesion requests once partial decisions have been made, rather than remanding the case solely to renew the incomplete adhesion phase, while § 349(2) StPO confirmed that no legal error to the detriment of the accused was found in the main criminal judgment.
