The Bundesgerichtshof dismissed the appellant's legal appeal (Rechtsbeschwerde) as inadmissible, thereby leaving the Landgericht Bonn's decision denying legal aid in force. The dispute concerned a procedural challenge to the rejection of an application for legal aid (Prozesskostenhilfe); the appellant improperly filed a legal appeal directly to the Federal Court of Justice rather than the required immediate appeal (sofortige Beschwerde) to the Oberlandesgericht. The court ruled that a "jump appeal" (Sprungrechtsbeschwerde) is statutorily prohibited in legal aid proceedings, as the exclusive remedy is an appeal to the competent appellate court under § 127 Abs. 2 Satz 2 ZPO, and further noted the filing was invalid because it was not submitted by a lawyer admitted to the Federal Court of Justice under §§ 575 Abs. 1 Satz 1, 78 Abs. 1 Satz 3 ZPO and § 574 Abs. 1 ZPO.

Volltext

Die Rechtsbeschwerde gegen den Beschluss der 15. Zivilkammer des Landgerichts Bonn vom 5. Januar 2024 wird als unzulässig verworfen.

[GRUENDE]

§ 575

Abs. 1 Satz 1,

§ 78 Abs. 1 Satz 3 ZPO

).
