Denial of legal aid for Rechtsbeschwerde where appeal brief lacked attorney signature and challenge to unchallengeable procedural orders
Legislator-Zusammenfassung
KI-generiertThe BGH 9th Civil Senate rejected the plaintiff's application for legal aid to file a legal complaint (Rechtsbeschwerde), leaving the Lower Court's dismissal of the appeal and the rejection of legal aid in force. The dispute concerned the procedural validity of an appeal in a civil matter where the appellant attempted to challenge a lower court's denial of legal aid and the subsequent rejection of his "counter-remonstrance," as well as a separate appeal dismissal. The court held that the legal complaint was inadmissible or lacked a prospect of success on all counts: first, legal aid denials are not generally appealable unless specifically admitted, which did not occur here, and the rejection of counter-remonstrances is unchallengeable; second, the underlying appeal was correctly dismissed as inadmissible because the appeal brief was not signed by an attorney, in violation of mandatory procedural representation requirements under §§ 519(4) and 78(1) Sentence 1 ZPO.
