Legislator-Zusammenfassung

The BGH 6a. Zivilsenat rejected the plaintiff's non-admission complaint, leaving the appellate court's decision in force and ordering the plaintiff to bear the costs of the proceedings. The dispute involved a challenge to the procedural history of the case, specifically the admissibility of the plaintiff's appeal in the lower instance. The decisive legal basis was § 543 Abs. 2 Satz 1 ZPO, under which the court determined the case lacked fundamental significance or required revision for the development of law; furthermore, the court noted that the plaintiff's appeal had been inadmissible because the appellant failed to challenge all material grounds of the lower court's decision, a defect the appellate court was required to check ex officio.

BGH, aaO, Rn. 12 ff. mwN).

Von einer weiteren Begründung wird gemäß § 544 Abs. 6 Satz 2 Halbs. 2 ZPO abgesehen.

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).

Der Gegenstandswert des Beschwerdeverfahrens beträgt bis 30.000 €.
