Liability under § 826 BGB: Admissibility of appeal based on alleged procedural rights violation
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the appellants' non-admission complaint, leaving the appellate judgment of the Düsseldorf Higher Regional Court in force and ordering the appellants to bear the costs. The dispute concerned the rejection of claims for damages under the tort provisions of the Civil Code (§§ 826, 31 BGB), where the plaintiffs argued that the lower court had violated their procedural rights by failing to recognize these liability claims. The BGH found no grounds for admission, concluding that the case lacked fundamental legal significance, did not require the development of law or the assurance of uniform jurisprudence, and that the alleged procedural rights violations were not substantiated.
