Liability of motor manufacturers for vehicle emissions: causality of damage and participation in intentional statutory violations under §§ 826, 823(2) BGB
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's non-appealability complaint, leaving the appellate court's judgment in force and ruling in favor of the defendant. The dispute involved a liability claim where the plaintiff, as a consumer, alleged that a motor manufacturer (the defendant) was liable for damages based on intentional tortious conduct and violation of the European Fuel Quality Directive by the vehicle manufacturer. The Court found no grounds for leave to appeal, noting that the appellate court's rejection of the tort claim due to a lack of causal damage was a standalone, dispositive rationale that the plaintiff failed to adequately challenge. Furthermore, the plaintiff failed to demonstrate decisional relevance for claims under tort law in conjunction with environmental regulations, specifically because the defendant was a component producer rather than a vehicle manufacturer and thus could not be shown to have participated in the alleged intentional statutory violation.
