Legislator-Zusammenfassung

The Federal Court of Justice dismissed the plaintiff's complaint for non-admission to the revision instance, resulting in the final confirmation of the appellate court's decision, which upheld the lower court's rejection of the plaintiff's claim. The dispute concerned a failure to adequately substantiate the use of a shutdown device as required by Regulation (EC) No. 715/2007, specifically Article 3, No. 10, regarding energy market access or security of supply. The Court of Appeal had independently grounded its refusal to accept the claim on the plaintiff's insufficient factual disclosure regarding the operational details of the shutdown device. The Bundesgerichtshof determined that the case lacked fundamental significance for legal development or uniform jurisprudence under Section 543(2) Sentence 1 ZPO, as the plaintiff failed to demonstrate a valid ground for admitting the appeal, and ordered the plaintiff to bear the costs of the complaint proceedings.

2 ZPO abgesehen.

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).

Der Gegenstandswert des Beschwerdeverfahrens beträgt bis 35.000,- €.
