Right of withdrawal extinguished upon full performance of consumer loan under EU Directive 2008/48
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff’s non-admission complaint, leaving the lower court’s decision in force and ruling against the consumer, thereby denying leave to appeal. The dispute concerned whether a borrower retains the right of withdrawal under Article 14(1) of Directive 2008/48/EC after a loan agreement has been fully performed. Relying on recent European Court of Justice jurisprudence and the BGH’s own precedent, the court held that the right of withdrawal extinguishes upon the complete fulfillment of the loan contract, meaning the plaintiff could not exercise it after all installments had been paid. The BGH determined that the case lacked fundamental legal significance, as the applicable law was already settled, and ordered the plaintiff to bear the costs of the appellate proceedings, fixing the value in dispute at no more than €30,000.
