Liability under German Food and Feed Law: Rejection of Tort Claim Due to Absence of Damage
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint for non-admission of appeal, rejecting the claim that the underlying legal issues possessed fundamental significance or required uniform jurisprudence, thereby leaving the appellate court's dismissal of the plaintiff's claims in force and ordering the plaintiff to bear the procedural costs. The dispute concerned a liability action under § 823 para. 2 BGB in conjunction with the German National Food and Feed Law (EG-FGV), specifically challenging the lower court's rejection of damages for alleged violations of §§ 6(1) and 27(1) of the EG-FGV. The decisive legal basis for the dismissal was § 543 para. 2 sentence 1 and § 544 para. 6 sentence 2 second half-sentence ZPO, as the plaintiff failed to sufficiently demonstrate the decision-relevance of the raised legal questions; the BGH noted that the appellate court had independently and sustainably grounded its rejection of the claim on the absence of damage, rather than solely on the statutory elements of the tort.
