Legislator-Zusammenfassung

The Federal Court of Justice (BGH) dismissed the debtor's appeals filed on January 19, 2024, and February 26, 2024, as inadmissible, imposing the costs on the debtor and leaving the Landgericht Würzburg's decision of September 13, 2023, in force. The dispute concerned a motion for leave to appeal (Nichtzulassungsbeschwerde) and a legal revision (Rechtsbeschwerde) within a compulsory enforcement procedure, where the appellant challenged the appellate court's failure to grant leave for the higher instance appeal. Relying on § 574 Abs. 1 Satz 1 Nr. 2 ZPO, the court held that a legal revision against an appellate decision in compulsory enforcement proceedings is only admissible if the appellate court explicitly allows it, which did not occur in this instance; the court further affirmed that the non-allowance of such a revision is not subject to complaint and no constitutional right to an appeal against this specific procedural step exists.

Volltext

Die Rechtsmittel vom 19. Januar 2024 und 26. Februar 2024 gegen den Beschluss des Landgerichts Würzburg - 3. Zivilkammer - vom 13.

BGH, Beschluss vom 19. Mai 2022 - I ZB 26/22, juris Rn. 2; Beschluss vom 14. März 2023 - I ZB 2/23, juris Rn. 2, jeweils mwN).

II. Die Kostenentscheidung folgt aus § 97 Abs. 1 ZPO.
