Inadmissibility of correcting factual recitals in appellate judgments due to lack of evidentiary force
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant’s application to correct the factual findings of its own prior judgment, thereby denying the requested relief and leaving the operative part of the underlying decision unchanged. The dispute centered on a procedural request by the defendant to amend the recital of facts in an appellate judgment by replacing "security CD" with "recovery CD," which the court rejected as inadmissible because a summary of party submissions in the preamble of an appellate judgment generally lacks the formal evidentiary weight required for correction under § 320 of the Code of Civil Procedure, and no exception applicable after remand was present. The court decided without oral proceedings pursuant to § 320 para. 3 of the Code of Civil Procedure, citing established jurisprudence that such corrections are not permitted for appellate judgments unless they carry statutory evidentiary force.

[TENOR] Der Antrag der Beklagten, den Tatbestand des Urteils des Senats vom 6. Oktober 2011 zu berichtigen, wird als unzulässig abgelehnt.
[GRUENDE] 1
Dezember 1998 - V ZR 224/97, NJW 1999, 796; Beschluss vom 30. Oktober 2003 - I ZR 176/01, GRUR 2004, 271; Musielak/Musielak, ZPO, 9. Aufl., § 320 Rn. 3, jeweils mwN).
