Rejection of non-admission complaint for lack of fundamental significance in civil revision proceedings
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 11th Civil Senate dismissed the plaintiff's application to stay the proceedings and rejected the plaintiff's complaint for non-admission of revision against a Munich Higher Regional Court order, ruling that the matter lacked fundamental legal significance and did not require appellate intervention for the development of law or uniform jurisprudence; having assessed and denied the prospects of success for a full appeal, the court referred to prior decisions from May, June, and July 2020 for its reasoning and ordered the plaintiff to bear the costs of the proceedings, setting the value in dispute at up to €40,000. The dispute involved a civil matter where the plaintiff challenged the lower court's procedural decision, but the BGH found no basis under § 543 Abs. 2 Satz 1 ZPO to admit the case to the revision court, thereby leaving the lower court's decision in force. The decisive legal basis was the absence of fundamental significance or a need for uniform case law under § 543 Abs. 2 ZPO, supplemented by the court's preliminary assessment of the merits' lack of promise under § 544 Abs. 6 Satz 2 ZPO, which permitted the court to dispense with a detailed written justification.
