Denial of non-allowance complaint due to lack of fundamental legal significance and prospects of success for revision
Legislator-Zusammenfassung
KI-generiertThe BGH dismissed the plaintiff's motion to stay the proceedings and rejected his non-allowance complaint against the Munich Higher Regional Court's decision, ordering the plaintiff to bear the costs of the complaint proceedings and setting the subject value at up to €45,000. This ruling upheld the lower instance's denial of leave to appeal, determining that the dispute lacked fundamental legal significance and did not require the Revisionsgericht to develop the law or ensure uniform jurisprudence, as the court also found no prospects of success for a revision. The decision relied on § 543 (2) sentence 1 ZPO for the denial of admission and § 544 (6) sentence 2 half-sentence 2 ZPO for the abbreviated reasoning, which referenced the court's established case law in similar matters from May, June, and July 2020.
