Tort claim under § 823 (2) BGB tied to EG-FGV shutoff device regulation: sufficiency of factual disclosure on use of the device
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure dismissed the plaintiff's complaint against the refusal to grant leave for appeal, thereby upholding the appellate court's judgment in force and ordering the plaintiff to bear the costs of the proceedings. The dispute concerned a tort claim under § 823 (2) BGB, which was rejected by the lower courts because the plaintiff failed to sufficiently prove the use of a shutoff device as defined in Art. 3 No. 10 of Regulation (EC) No. 715/2007. The supreme court found no reason for a revision, holding that the appellate court's rejection of the claim was independently supported by the finding of insufficient factual disclosure regarding the regulated shutoff device, thereby negating the alleged fundamental legal significance or need for legal development required under § 543 (2) (1) ZPO.

2 ZPO abgesehen.
Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
Der Gegenstandswert des Beschwerdeverfahrens beträgt bis 65.000,00 €.
