Admission to BGH revision: lack of fundamental legal significance in civil liability dispute
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice dismissed the plaintiff’s application to stay proceedings and rejected his complaint against the lower court’s refusal to admit revision, upholding the appellate judgment that dismissed the appeal; the dispute concerned a civil liability matter where the plaintiff challenged the lower court's denial of leave for appeal to the BGH, arguing issues of fundamental legal significance; the court held that no question of fundamental importance, legal development, or need for uniform jurisprudence existed to justify revision, explicitly noting that it had assessed the prospects of a successful appeal on the merits and found them lacking, thereby barring further review under Section 543(2) of the Code of Civil Procedure and referencing consistent recent precedent.
