Liability of component manufacturers for participation in intentional statutory violations under §§ 826, 823(2) BGB
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's complaint for non-acceptance of revision, leaving the decision of the Oldenburg Court of Appeal in force, thereby favoring the defendant. The dispute concerned claims for tortious damages under §§ 826, 823(2) BGB against a component manufacturer (engine producer), with the plaintiff alleging that the defendant had participated in the intentional violation of vehicle safety and emission regulations enacted by the vehicle manufacturer. The BGH ruled that the plaintiff failed to establish grounds for accepting the appeal to revision, specifically noting that the defendant's status as a component manufacturer rather than a vehicle manufacturer precluded liability for the alleged intentional statutory violation, citing established case law, and finding the asserted procedural fundamental rights violations unconvincing.
