Product Safety Regulation compliance: Admissibility of non-leave to appeal regarding fault, heat window mitigation, and coolant temperature control evidence
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure (BGH) rejected the plaintiff's complaint against non-leave to appeal, thereby allowing the lower court’s judgment to stand in favor of the defendant. The dispute concerned a consumer claim alleging a violation of product safety standards, specifically challenging the defendant's compliance with Article 6(1) and Article 27(1) of Regulation (EC) No 1935/2004 on food-contact materials. The appellate court had dismissed the claim based on the absence of fault, reasoning that the presence of a heat window negated the alleged defect and that the plaintiff failed to provide sufficient evidence for the use of a specific coolant set-temperature control. Relying on §§ 543(2) and 544(6)(2) of the Code of Civil Procedure (ZPO), the BGH held that the applicant failed to demonstrate the fundamental significance of the legal issues or the necessity of legal development, and further found that the asserted violations of procedural fundamental rights were not compelling.
