Tort liability for violation of environmental law: rejection of non-admission of revision for lack of damage and fault.
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) rejected the plaintiff's complaint for non-admission of revision, thereby upholding the appellate court's judgment and leaving the lower court's decision in force. The dispute concerned a tort claim where the plaintiff alleged damages caused by the defendant's conduct, which the appellate court had dismissed on two independent grounds: the absence of damage and the absence of fault. The BGH held that the appellant failed to establish grounds for admission under § 543 Abs. 2 ZPO, as the legal issues did not possess fundamental significance or require further legal development, and found no substantive violation of procedural fundamental rights. Consequently, the plaintiff bears the costs of the appeal proceedings, and the amount in dispute is capped at 35,000 euros.
