Exclusion of oral hearing in lawyer disciplinary revision when dismissal by order is available under § 349 StPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the lawyer's revision as unfounded, upholding the judgment of the Anwaltgerichtshof Nordrhein-Westfalen and ordering the lawyer to bear the costs of his legal remedy. The case involved an appeal in lawyer disciplinary proceedings where the defendant challenged the lower court's decision, while simultaneously requesting a mandatory oral hearing. The court held that no right to a main hearing in the revision proceedings exists when the appeal is manifestly unfounded and dismissed by interlocutory order upon the application of the General Federal Prosecutor, citing that such a requirement does not follow from Article 103(1) of the Basic Law or Article 6 of the ECHR, and that no special circumstances under Article 12(1) of the Basic Law warranted a decision by judgment under § 116 Abs. 1 Satz 2 BRAO in conjunction with §§ 349 Abs. 2, 5 StPO.

Volltext
BVerfG, NJW 2014, 2563; Gericke in KK-StPO, 9. Aufl., § 349 Rn. 15; jeweils mwN). Dezember 1991 - 2 StbStR 2/91, BGHSt 38, 177, 178 f.; Meyer-Goßner/Schmitt, StPO, 66. Aufl., § 349 Rn. 6, 7).
